What Is a Prenuptial Agreement

Thursday, August 30th, 2007

By Dmitry Skrotski A prenuptial agreement is a contract entered into by two people prior to marriage. As a rule, the content of a prenuptial agreement varies widely, but commonly includes provisions for the division of property should the couple divorce and any rights to spousal support during or after the dissolution of marriage. Both spouses should feel they gain from the marital agreement. The motivation of a person seeking a premarital agreement usually falls into one of two categories: the person with the assets wants his or her separate assets protected in the event of a divorce; or the person who holds few, if any, assets is giving up a career to stay home and raise a family and, thus, wants to be financially compensated for the loss of his or her career. In general, a prenuptial agreement deals with the following: division of property on separation; inheritance of property; ownership of property (what is owned jointly and what is owned separately); the right to direct the education and moral training of their children and spousal support obligations. There are certain limitations to prenuptial agreements. They cant deal with custody or access to children; in a marriage contract, the right to remain in the matrimonial home; and in a marriage contract, the right to sell or transfer the matrimonial home. Financial as well as divorce matters are often considered to be last on the list of issues a couple wishes to think about when they plan the wedding. However, if the context is proper, such thoughts and discussion can lead to a prenuptial agreement. Then it is viewed by both parties as a precaution made in order to prevent an expensive settlement of their divorce. Small Business Owners - Try These Design Tips to Create a Professional Looking Company Newsletter

Wednesday, August 29th, 2007

By Suzanne Lieurance If you’re the owner of a small business, the thought of creating a company newsletter or ezine can be a little scary. If you have little or no graphics design experience you may not know what to do to create a professional looking ezine or newsletter, and not one that screams, “I DID THIS ALL BY MYSELF!” One way around this it to hire someone to create the newsletter for you. But not every small business owner has the funds for this. Still, a company newsletter is one of the best marketing tools you can create for your business. So try the following tips and develop a professional looking newsletter you’ll be proud of: 1. Pick one font for headlines and subheads, another for text. A good combination is a bold sans serif headline font (like Futura ExtraBold Condensed or Helvetica Heavy or a modern-looking font like Meta, Moderna, or Officina San Serif) paired with a simple serif font (Times, Garamond or Garamond Condensed, Galliard, etc.) for text. Use a smaller italicized version of text font for photo captions. 2. ALL text should be the same size (12 point usually, or sometimes 10 or 11 point, depending on the font); use uniform sizes for heads and subheads–larger headlines for more important articles. Most page layout and word processing programs let you set up style sheets. Set up a style for text, headlines, subheads, captions, etc. This is a very easy way to lay out the newsletter, making sure all fonts and sizes are uniform. 3. Flush left/ragged right text looks best. Justified columns can leave weird looking spaces between words, and centered headlines, text, and ads tend to give the newsletter an amateur appearance. 4. Look at some newsletters. Find a design you really like; set your newsletter up the same way - same number of columns, same size margins, and same size sidebars on each page. Don’t try to make each page have its own design. Pages should have a uniform look. Follow these tips to create a short, simple newsletter at first. Over time, you can develop additional topics and columns for your newsletter. First, just learn the basics of creating a professional looking publication that can be used to help create a closer, ongoing relationship with your customers and clients. The Convenience of Online Bill Paying

Saturday, August 25th, 2007

By Jeff Lakie If you are like most people, you know that paying bills is an important part of maintaining good credit. If you are late or if you miss payment on a particular bill, you could soon find yourself hit with dunning letters or worse: your credit score could take a hit. Thanks to online bill paying those cares are done away with for the most part. If you arent paying the majority of your bills online then you are missing out on a step that is convenient, affordable, and a great organizer. Online bill paying came of age in the late 1990s when many commercial banks began to encourage this option for their customers. Many banks charged a nominal monthly fee for this service but quickly did away with it once they realized that check processing fees were dropping dramatically and when small competitors rushed in to offer their online bill paying services for free. Starting online bill paying is easy and your current bank may already offer this for you. If so, simply ask your banking representative how to sign up and then take it from there. If you bank doesnt offer online bill paying, consider visiting a competing bank to open up a checking account with them. Shop around as several banks still offer free checking or free checking with a minimum monthly balance. If online bill paying is offered, you can benefit by: Scheduling monthly payments that are for the same amount every month such as your mortgage, car loan, or student loan payment. When bills arrive, log on and set up payments to be paid on days that you designate. Pay the phone bill on the 9th, the water bill on the 14th, the cable bill on the 16th, your store card on the 21st, and so on. Or, you can simply enter the amounts due and payment will be made to each account as soon as possible. Even if you wanted to make payment to a friend in another state you can set up a bill payment for them and the bank will write out a check and deliver it to them with no additional charge for you. Best of all you can track bills, transfers, debits, and credits from the convenience of your computer. You get instant access to your statements; no need to wait monthly for your post office delivered paper copy: you can read an up to date statement at any time of the day! Yes, online banking is here and it is here to stay have you taken advantage of this terrific method of paying and tracking invoices yet? New Depression and Anxiety Info: The Epidemic of Anti-Depressants

Thursday, August 23rd, 2007

By Kari Joys There is an epidemic in society today of people who are taking anti-depressants and anti-anxiety medications to survive their emotional and psychological pain. Doctors, psychologists, and psychotherapists regularly recommend long-term medication to deal with depression, anxiety, and dysfunctional family issues, usually with the best of intentions, simply because they are not familiar with the emotional healing process. As we begin the twenty-first century, psychology as a whole has reached the point of being able to diagnose a client’s problem and recommend appropriate medications, but it hasn’t yet agreed on any definitive process for helping clients actually overcome their issues. Therefore many skilled psychotherapists are still recommending psychotropic medication and teaching people coping skills for how to live with what is currently assumed to be their life-long psychological issues, rather than giving their clients the tools they need to overcome those issues. Since information about the emotional healing process has not yet been researched and documented, many clients are not told about the possibility of overcoming their emotional issues and living healthy, functioning lives. I find it very unfortunate that with all the knowledge and skills we have accumulated, many clients in every-day counseling situations are still not given clear direction for how to get from their painful, survival existence to a happy, functioning life. Emotional healing, a natural process, occurs spontaneously when a person feels safe and supported in an open, healing environment. The doors that have been locked in a person’s unconscious mind will open naturally and easily when he or she experiences the authentic compassion of an experienced professional. If a professional follows the natural healing process of a client’s unconscious mind, that healing process will guide the client back to peace and happiness, much like the natural process of grief. Clients in emotional pain need to hear from compassionate, experienced professionals that with patience and persistence it is absolutely possible to heal emotionally. People suffering pain also need to be given clear guidance and direction about what they can expect to experience on their emotional healing journey. Emotional healing is not always an easy road, but when a person overcomes the pain and creates a happy, fulfilling life, it is extremely rewarding! I am not suggesting, of course, that professionals should never recommend psychotropic medication. Clearly there are times when medication is necessary. I like to think of psychotropic medication as a short-term help for clients who are suicidal or in severe crisis when used along with counseling or psychotherapy, while the client is learning the important skills needed for living without it. The problem with prescribing medication on a long-term basis is that anti-depressants have only been available for the past twenty years and anti-anxiety medications only a few years more. We have not yet had time to research the long-term effect of these medications on our physical health. I believe that although anti-depressants and anti-anxiety medications are often a necessary tool to meet short-term psychological needs, taking high doses of medication to numb emotional pain on a long-term basis will never bring a person to that experience of inner peace, joy and fulfillment that they are seeking. Only a holistic approach that includes body, mind, and spirit will accomplish that goal. 2006 Kari Joys Why spend another day feeling anxious and depressed when you can begin this exciting emotional healing journey right now? Even if you grew up in an extremely dysfunctional family, with patience and persistence you could actually overcome a lifetime of negative patterns by following Kari Joys simple 33-day emotional healing journey! Jesus Never Preached Poverty

Wednesday, August 22nd, 2007

By Rob Marshall A recent Time magazine cover had a picture of a Rolls Royce with a cross as the hood ornament. The headline read: “Does God Want You To Be Rich?” The article talked about a trend that is developing within the American church to preach what some call the “Prosperity Gospel.” I sometimes wonder what all the controversy is about. I remember going to a meeting with some other Christians and listening to the preacher talk about God’s blessings. After the event was over, one of the people I was breathed a sigh of relief and said, “For a minute there I was worried that he was going to start preaching health and wealth.” I believe that I understand what this person was getting at, but I have to ask: “Would you have felt better if he had preached sickness and poverty?” There is a lot of confusion around the topic of God’s blessings in our lives and what it means to live an abundant life. And I have no doubt that some preachers are simply teaching something that a lot of people want to hear, and they may not be all that sincere. But I also believe that God wants to bless His people, and no they don’t have to wait until they get to heaven, and yes they can, and should, create and enjoy wealth in this life. A story from the Gospels that is often cited when talking about the evils of riches is the story of the rich young ruler. This young man came to Jesus asking about what he needed to do so that he could have eternal life. (Matthew 19:16-26) What I find interesting is that Jesus answered his question in some very odd ways. If we look at it from a “Christian” point of view, He said some things that really don’t make sense. The first thing he told him was to obey the commandments. That’s odd because Paul tells us in Galatians 2:16 that no man will be justified by obeying the law, but through faith in Christ. And I know that some people may say, “Yeah, but this was before Jesus died on the cross.” Still, even the Old Testament taught that the righteous live by faith. Even Abraham was justified in God’s eyes because of his faith. God’s word has always taught that we are justified by faith and not by works. But even this young man realized that obeying the law wasn’t enough because when Jesus gave him a list of commandments that he was to obey, he replied, “‘All these I have kept,’ the young man said. ‘What do I still lack?’” (Matthew 19:20) It was then that Jesus said, “If you want to be perfect, go, sell your possessions and give to the poor, and you will have treasure in heaven. Then come, follow me.” (Matthew 19:21) The story goes on to say that this man went away sad because he had great wealth. Now before we begin to think that Jesus just told this man he could earn his way in to heaven by giving his money away, let’s take a look at what Jesus said. He just gave this man an incredible promise. He told him that, if he would give his earthly wealth away, he would have treasure in heaven. Jesus wasn’t trying to find out if this man was too attached to his wealth, He was pointing out that this man didn’t really believe in heaven. Let me ask you a question. If God said to you, “Sell everything that you have here on earth, where moths eat it, rust corrupts it, and thieves steal it, give it to the poor and I’ll make sure you can enjoy it forever,” what would you say? Well, if you believed in heaven you’d say, “You got a deal!” This young man, and everyone who trusts in their earthly wealth more than in their heavenly treasures, will have a hard time getting into heaven. Jesus wasn’t preaching to this man that he needed to earn his way into heaven by being poor, He taught us all that our faith, what we really believe, is displayed by our actions. Things To Think About When Choosing A Beauty Product

Monday, August 20th, 2007

By Judy Sweet When you are trying and needing to decide on a beauty product, There are several things you will need to consider first. By taking time and effort beforehand, you will be able to choose smartly on a beauty product that is excellent for you, and so obviously the time and effort spent beforehand will be well worth it in the end. Some Recommendations to look for when choosing a Beauty Product: 1, If you have any allergies you need to take this into consideration because you would not want to buy a beauty product that could affect your health. 2, Take into consideration your skin type. If you have oily skin for example you don’t want to buy a Beauty Product that enhances your oily skin, the same would apply if you have dry skin you would not want a Beauty Product that will dry skin even more. 3, You also want to take cost into consideration as while some expensive beauty products are worth it there are of course some that are far too expensive. It can take some time to determine if products are worth buying or not but in the long run and can save you a lot of money. Most beauty stores will let you try the products on as testers before you buy them, this what you really want so you can see which beauty products work with your skin, hair and what ever else. you can quite easily make a day of this and enjoy trying out all the beauty products that are on offer. Physician Assisted Suicide And The Art of Care

Monday, August 20th, 2007

By Sam Oliver In an age of managed care, rationing of care, and technological care, there is The Art of Care. We live in a society that has been given various choices to self-determine ones destiny in dying as one has been able to self-determine ones destiny in life itself. We have medicines and technological capabilities, and areas of the country allowing us to hasten or postpone ones dying. The purpose of this position paper is to outline the legal, ethical, religious, and philosophical ramifications involved in Physician Assisted Suicide (PAS) and how affects of such decisions effect those connected to this issue. The pros for PAS are: People should have the right to die with dignity People should have the right to die with their senses intact People should have the right to die free of pain People should have the right to take charge of futile care The cons for PAS are: Slippery-slope effect, or acceptable and unacceptable euthanasia No policy is able to effectively govern the scope of the right to die True wishes are hard to discern due to communication challenges Playing God I am simply giving an overview, and not, a detailed analysis on this issue. My intent is to surface the issues in PAS and move toward a philosophy of care that can minimize peoples fear of death by the utilization of a type of care = The Art of Care. The Art of Care will help people gain inner strength that can enable him or her to cope with the external losses happening to their body. At the end of this paper, I hope to outline practical ways people can help terminal patients cope with a dying body from a place inside them that remains steadfast their soul. It was Karl Barth who said that it is for God and God alone to make an end to human life and that God gives life to us as an inalienable loan. It is my belief that we are given meaning and hope in all life situations. This instinct to survive and find value in all of our existence leads me to trust that there is much to learn in all phases of our life. Our ability to trust our Creators divine guidance and plan to make us more soul than body at the end of life is just as important as other aspects of living as well. We may do well to trust more and control less. It appears that maturity teaches us all to let go and follow a path inside us that does not always make sense to us externally. As we do, we begin to follow insight. To see from within what cannot be seen from without is our souls longing to be known and to surface in our lives. In On Liberty, John Stuart Mill cautions, A person should be free to do as he likes in his own concerns, but ought NOT to be free to do as he likes in acting for another, under the pretext that the affairs of the other are his own affairs. Autonomy is so important to us that science, as well as religious communities strive to honor and respect it. For within autonomy is the ability for one to discern for him or herself ones needs, values, and destiny. This is a movement into the art of care (science and religion) can work together in forging a healing response on the level of soul when physical cure is no longer possible. On the other side of this issue, it is evident that the Oregons Death with Dignity Act has had its impact on America. Some people want this service available even if it is not chosen by a great number of people. The Oregon s Death with Dignity Act has been used very sparingly and a slippery slope does not appear to be in the present forefront. In 2001, twenty-one Oregonians chose to end their lives by ingesting a lethal dose of medication prescribed by a physician, accounting for 0.33% of the 6,365 Oregon deaths from similar diseases. The number of Oregonians opting for physician-assisted suicide has remained fairly stable, ranging from sixteen in both 1998, the first year the law was in effect, to twenty-seven in both 1999 and 2000. Clearly, there is no landslide in the making. It seems then, that people still want to have some sort of control in their dying and autonomy remains prevalent throughout the issue with PAS. This strong need to determine ones path in the face of suffering offers us hope, faith, and love in a sense of the self not easily defined without losing the grandeur of a trust within oneself to be led by the same power that brought our lives into being. It is here that we turn to the art of care to help us when curative care no longer has any answers. Here, we begin where we end, in that we trust in the very wisdom that has created us. Beware of the Fear Factor!

Saturday, August 18th, 2007

By Mark Dotson Some companies are attempting to sell wildlife control services using fear and lack of consumer knowledge as their selling point. If you experience a wildlife problem and call a company to resolve it, question their ethics if they try to scare you with disease issues or fear that the animal will find it’s way into your home and bite you. This is a tactic to scare you into hiring them and should not be tolerated. With so many new companies popping up all the time and trying to “cash in on a quick buck”, they may try to deceive you into doing something you may not ordinarily do. Don’t let them separate you from your hard earned money with fear! How do you counteract these types of companies? Ask them for copies of their Nuisance Wildlife license, their business license and their certification credentials. Call the Better Business Bureau and see if the company has any negative records. Good companies never have to use these techniques to help you make the decision how to control the wildlife problem. Companies that do not understand the nature of this type of work often resort to fear and intimidation as well as exorbitant prices to sell you their services. If you feel as if you are being subject to a salesperson using these sort of techniques, do some homework. Find out what is the best and most cost effective way to resolve the wildlife conflict. Turn this company into the agency they are licensed through so no one else will be a victim of their tactics. Armed with this information, you can be assured of receiving a safe and effective solution to your wildlife problem. Thursday, August 16th, 2007

By Ray Kelly When it comes to losing weight, what do you think is the biggest contributing factor? The food you eat? The amount of exercise you do? Genetics? You just have to look at the latest series of The Biggest Loser to get your answer: Its attitude! Ive worked with many losers over the past 15 years and I can tell you from experience that if you dont have the right attitude, you just wont succeed. The way you think effects the way you feel, and the way you feel effects the amount of effort you put in. So, back to The Biggest Loser. Remember Nick? He was the guy voted off in week 3. Boy, did he have an attitude! Hes got people around him, trying to push him, trying to get the best out of him so that he can succeed. But what does he do? He fights them. The trainers are trying to help him but his ego wont allow him to accept that help. Hes more concerned with not getting pushed around, than actually getting on with the job and losing weight. I mean, who are the experts here? Compare this with Pete. A guy who, Im sure doesnt like being pushed around, but accepts that hes there for a reason. He has a problem and there are people there willing to help him. All he has to do is listen to what they say, then do it! Well, the results are there for all to see. As each contestant gets voted off, they show a Where are they now clip. When Nick was shown, he had the same attitude and also looks like he may have put on more weight. Pete on the other hand looks fantastic. So what has this got to do with every person on this planet that wants to lose weight? Change the way you think and you will succeed! Each day when you wake up, dont think about the foods youre going to miss out on or the exercise you have to do. Think about how good youre going to feel, how great youre going to look, and how better life will be! There are many people out there that want you to succeed and are willing to help you.
